PLEASE READ THESE TERMS CAREFULLY BEFORE USING FISHLOGIC. By downloading, installing, accessing, or using FishLogic ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must immediately uninstall the App and discontinue all use.
These Terms constitute a legally binding agreement between you and FishLogic ("we," "us," "our"). We reserve the right to modify these Terms at any time. Your continued use after modifications constitutes acceptance of the updated Terms.
This agreement constitutes a legally binding End User License Agreement ("EULA") between you and FishLogic. This EULA governs your use of the FishLogic application downloaded from the Apple App Store.
License Grant: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, solely for personal, non-commercial purposes.
License Restrictions: You may not: (a) copy, modify, or distribute the App; (b) reverse engineer, decompile, or disassemble the App; (c) rent, lease, lend, sell, or sublicense the App; (d) remove any proprietary notices; (e) use the App for any commercial purpose; or (f) transfer the App to another device without deleting it from the original device.
Apple EULA Terms: You acknowledge that this EULA is between you and FishLogic only, not with Apple. FishLogic, not Apple, is solely responsible for the App and its content. Apple has no obligation to provide maintenance or support services for the App.
FishLogic provides AI-powered fishing guidance based on environmental conditions, seasonal patterns, weather data, and fish behavior models. The App offers probabilistic recommendations on fishing areas, depths, structure types, and lure selections.
CRITICAL DISCLAIMER: FishLogic provides INFORMATIONAL GUIDANCE ONLY based on algorithmic analysis and artificial intelligence predictions. The App is NOT a guarantee of fishing success. We make NO WARRANTY, EXPRESS OR IMPLIED, that you will catch fish or that our recommendations are accurate, complete, or suitable for any particular purpose.
Fishing success depends on numerous factors beyond our control or prediction, including but not limited to: actual fish behavior, angler skill and experience, equipment quality, real-time weather changes, water conditions, fish feeding patterns, fishing pressure, seasonal variations, and random chance.
You must create an account using Apple Sign-In or Google Sign-In to access the App. By creating an account, you represent and warrant that:
We reserve the right to refuse service, terminate accounts, or restrict access at our sole discretion, with or without cause or notice.
5.1 Trial Period: New users receive a 3-day free trial beginning at account creation. During the trial, you have full access to features based on your selected subscription tier. When the trial expires, you must subscribe to continue using the App.

IMPORTANT — AI LIMITATIONS: FishLogic uses artificial intelligence (powered by Anthropic's Claude) to generate fishing recommendations. You acknowledge and agree that:

BY USING FISHLOGIC, YOU EXPRESSLY ACKNOWLEDGE AND ASSUME ALL RISKS ASSOCIATED WITH FISHING AND BOATING ACTIVITIES. Fishing and boating are inherently dangerous activities that can result in serious injury, death, or property damage. Risks include but are not limited to:

YOU ARE SOLELY RESPONSIBLE for complying with all applicable fishing laws and regulations, including obtaining valid fishing licenses, following catch limits and size restrictions, observing seasonal closures, and complying with all federal, state, and local laws.

The App displays weather data from third-party sources (Open-Meteo and World Weather Online). Weather information may be delayed, inaccurate, incomplete, or subject to rapid change. ALWAYS verify weather conditions from official sources before going on the water.
The App may contain links to third-party retailers, including Amazon.com. These are affiliate links, meaning FishLogic may earn a small commission if you make a purchase through them, at no additional cost to you. FishLogic is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for apps to earn advertising fees by advertising and linking to Amazon.com.

The App displays lake boundaries, fishing areas, structure locations, and depth estimates for informational purposes only. Map data may not reflect actual or legal property boundaries. Structure locations and depths are approximations. You must respect all posted property boundaries and private property.
You agree NOT to: use the App for any unlawful purpose; attempt unauthorized access to our systems; interfere with App functionality; copy, modify, or distribute App content; use automated systems to access the App; reverse engineer the App; share account credentials; attempt to circumvent usage limits; or resell App content.
All content, features, and functionality of the App, including text, graphics, logos, algorithms, software, data compilations, AI models, and fish behavior datasets, are owned by FishLogic or its licensors and protected by intellectual property laws.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT: (A) YOU WILL CATCH FISH; (B) RECOMMENDATIONS WILL BE ACCURATE; (C) THE APP WILL MEET YOUR REQUIREMENTS; (D) THE APP WILL BE AVAILABLE WITHOUT INTERRUPTION; OR (E) ERRORS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FISHLOGIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING PERSONAL INJURY, DEATH, PROPERTY DAMAGE, LOSS OF PROFITS, OR ANY DAMAGES ARISING FROM YOUR USE OF THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100).
You agree to indemnify, defend, and hold harmless FishLogic from any claims, liabilities, damages, losses, costs, and expenses arising from your use of the App, violation of these Terms, violation of any law, your fishing or boating activities, or any content you submit.
Governing Law: These Terms shall be governed by the laws of the State of Georgia.
Arbitration: Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association Consumer Arbitration Rules.
CLASS ACTION WAIVER: You agree that all disputes will be resolved on an individual basis. You waive any right to participate in a class action or jury trial.
Time Limitation: Any claim must be brought within one (1) year of the date the claim arose.
We may suspend or terminate your access at any time, with or without cause. Upon termination, your right to use the App ceases immediately. Provisions regarding disclaimers, limitations of liability, indemnification, and dispute resolution survive termination.
If you are located in the EU/EEA/UK: Nothing in these Terms affects your statutory consumer rights. The limitations of liability apply only to the extent permitted by applicable law. We do not exclude liability for death or personal injury caused by our negligence, or for fraud. You may lodge a complaint with your local data protection supervisory authority.
If any provision is found invalid or unenforceable, the remaining provisions continue in full force.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FishLogic regarding use of the App.
